  1. Definitions

    For the purposes of these Terms and Conditions, the following terms shall have the meanings set out below:

    1. Buyer – a natural person, a natural person making a purchase not directly related to their business or professional activity, a natural person making a purchase directly related to their business or professional activity, a legal person, an incomplete legal person or other entities or persons making a purchase in the Store.
    2. Payment Operator – the przelewy24.pl service, owned by PayPro Spółka Akcyjna with its registered office in Poznań at ul. Pastelowa 8, 60-198 Poznań, entered in the Register of Entrepreneurs of the National Court Register maintained by the District Court Poznań Nowe Miasto i Wilda, VIII Commercial Division of the National Court Register under KRS number 0000347935, NIP number 7792369887, with share capital of PLN 4,500,000.00, fully paid up.
    3. Order fulfilment – preparation for shipment and dispatch by the Seller of the purchased physical product.
    4. Terms and Conditions – these Terms and Conditions.
    5. Store – the online store available at https://wyplatamy.pl.
    6. Seller – Maciej Dąbrowski based in Warsaw, ul. Łojewska 10/28, 03-392 Warsaw, NIP: 1132802300, REGON: 387493416, BDO: 000507167.
  2. General Provisions
    1. Through the Store, the Seller sells physical products and electronic products, while simultaneously providing the Buyer with services by electronic means in accordance with § 3 of the Terms and Conditions.
    2. The Terms and Conditions define the rules and conditions of using the Store, as well as the rights and obligations of the Seller and the Buyer.
    3. To make a purchase through the Store, the Buyer's computer or other device does not need to meet any special technical requirements. The following are sufficient:
      1. access to the Internet,
      2. a standard operating system,
      3. a standard web browser,
      4. an active e-mail address.
    4. To use an electronic product, the Buyer's computer or other device must meet the following technical requirements:
      1. access to the Internet,
      2. a standard operating system,
      3. a standard web browser,
      4. a standard .pdf file reader (e.g. AdobeReader),
      5. an active e-mail address.
    5. The Buyer is prohibited from providing unlawful content, in particular by sending such content via forms available in the Store.
    6. All prices in the Store are gross prices and are given in Polish zloty.
    7. The final price of the order consists of the price of the product and the delivery cost indicated on the Store's pages.
  3. Services provided by electronic means
    1. Through the Store, the Seller provides the Buyer with a service by electronic means consisting of enabling the Buyer to conclude with the Seller:
      1. an agreement for the delivery of digital content in the form of electronic products available in the Store,
      2. an agreement for the delivery of physical products available in the Store.
    2. Concluding an agreement is possible without having an account in the Store. The procedure for concluding an agreement is described in detail in § 5 of the Terms and Conditions.
    3. The service is provided to the Buyer free of charge. However, agreements for the delivery of digital content or physical products concluded through the Store are subject to a fee.
  4. Intellectual property rights
    1. The Seller hereby informs the Buyer that some physical and electronic products available in the Store constitute works within the meaning of the Act of 4 February 1994 on copyright and related rights, to which the copyright belongs to the Seller.
    2. The Seller hereby informs the Buyer that further distribution of electronic products by the Buyer without the Seller's consent constitutes an infringement of the Seller's copyright to the electronic products and may result in civil or criminal liability.
  5. Concluding an agreement
    1. In order to purchase a physical or electronic product, the Buyer must take the following steps:
      1. add the product or products to the cart by clicking the "Add to cart" button,
      2. from the cart view, click the "Proceed to checkout" button,
      3. complete the order form, providing the data necessary to fulfil the order and selecting the payment method,
      4. accept the Terms and Conditions – acceptance of the Terms and Conditions is voluntary but necessary to make a purchase,
      5. click the "Buy and pay" button.
    2. After clicking the "Buy and pay" button, the Buyer will be redirected to the Payment Operator's page to make payment for the selected products.
    3. After successfully making the payment, the Buyer will be redirected to the purchase confirmation page. From that moment, the following shall be deemed concluded between the Buyer and the Seller:
      1. an agreement for the delivery of digital content in the form of selected electronic products,
      2. an agreement for the delivery of physical products.
    4. The Buyer will also receive a purchase confirmation to the e-mail address provided in the order form.
  6. Fulfilment and delivery times
    1. Delivery of the purchased electronic product will take place by sending to the e-mail address provided in the order form a link enabling the electronic product to be downloaded or an access code to the product. Delivery will take place immediately after the Buyer's payment is credited to the Seller's account, no later than within 24 hours of the payment being credited.
    2. Fulfilment of an order for a prefabricated physical product will take place immediately after the Buyer's payment is credited to the Seller's account, no later than within 4 business days of the payment being credited.
    3. Fulfilment of an order for a non-prefabricated physical product, manufactured to the Buyer's specifications or serving to meet their individualised needs, will take place no later than within 10 business days of the payment being credited.
    4. Delivery of the purchased physical product is carried out in the manner chosen by the Buyer when placing the order. The delivery time depends on the chosen delivery method.
    5. If the Buyer suspects that the parcel containing the physical product has been opened or shows damage caused during transport, a damage report should be drawn up with the courier and the Seller should be contacted as soon as possible.
    6. Delivery of products takes place only within Poland.
  7. Buyer's right of withdrawal
    1. A Buyer who has concluded a distance contract with the Seller has the right to withdraw from the contract without giving reasons within 14 days from the date of conclusion of the contract.
    2. The right to withdraw from a distance contract does not apply to the Buyer with respect to agreements for the supply of digital content not stored on a tangible medium, if performance has begun with the Buyer's express consent before the expiry of the withdrawal period and after the Buyer has been informed by the trader of the loss of the right of withdrawal.
    3. The right to withdraw from a distance contract does not apply to the Buyer with respect to an agreement where the subject of the performance is a non-prefabricated item, manufactured to the Buyer's specifications or serving to meet their individualised needs.
    4. To withdraw from the contract, the Buyer must inform the Seller of their decision to withdraw from the contract by means of an unequivocal statement – for example, a letter sent by post, fax or e-mail.
    5. The Buyer may use the model withdrawal form available at https://www.wyplatamy.pl/formularz_reklamacji_zwrotu/.
    6. To meet the withdrawal deadline, it is sufficient for the Buyer to send information regarding the exercise of the Buyer's right of withdrawal before the expiry of the withdrawal period.
    7. In the event of withdrawal from the contract, the Seller shall reimburse the Buyer for all payments received from the Buyer immediately, no later than 14 days from the day on which the Seller was informed of the exercise of the right of withdrawal.
    8. The Seller may withhold reimbursement until receipt of the goods or until proof of their return has been provided, whichever is earlier.
    9. The Buyer should return the goods to the address: Nowopszczyńska 28, 44-240 Żory immediately, and in any case no later than 14 days from the day on which the Buyer informed the Trader of the withdrawal from the contract. The deadline will be met if the Buyer returns the goods before the expiry of the 14-day period.
    10. The Buyer bears the direct costs of returning the goods.
    11. The Buyer is only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
  8. Liability for defects
    1. The Seller is obliged to deliver a product free from defects to the Buyer.
    2. The Seller is liable to the Buyer if the product has a physical or legal defect (warranty for defects).
    3. If the Buyer finds a defect in the product, they should inform the Seller, specifying their claim related to the defect found or making a declaration of appropriate content.
    4. The Buyer may use the complaint form available at https://www.wyplatamy.pl/formularz_reklamacji_zwrotu/, however this is not mandatory.
    5. The Buyer may contact the Seller both by traditional mail and by electronic mail.
    6. The Seller will respond to the complaint submitted by the Buyer within 14 days from the date of delivery of the complaint using the same means of communication by which the complaint was submitted.
  9. Personal data and cookies
    1. The rules for processing personal data and the use of cookies are described in the privacy and cookies policy available at https://www.wyplatamy.pl/privacy-policy/.
  10. Out-of-court complaint and redress procedures
    1. The Seller agrees to submit any disputes arising in connection with the concluded agreements to mediation proceedings. The details will be determined by the parties to the dispute.
    2. The Buyer has the option of using out-of-court complaint and redress procedures. In particular, the Buyer has the option of:
      1. applying to a permanent consumer arbitration court with a request to resolve a dispute arising from the concluded agreement,
      2. applying to the regional inspector of the Trade Inspection with a request to initiate mediation proceedings for the amicable settlement of the dispute between the Buyer and the Seller,
      3. using the assistance of the district (municipal) consumer ombudsman or a social organisation whose statutory tasks include consumer protection.
    3. More detailed information on out-of-court complaint and redress procedures can be found on the website http://www.uokik.gov.pl.
    4. The Buyer may also use the ODR platform, which is available at http://ec.europa.eu/consumers/odr.
  11. Final provisions
    1. The Terms and Conditions come into force on the date of publication in the Store.
    2. The Seller reserves the right to make changes to the Terms and Conditions, which come into force on the date of their publication in the Store. Agreements concluded before the change of the Terms and Conditions are governed by the version of the Terms and Conditions in force on the date of conclusion of the agreement.
