TERMS AND CONDITIONS OF THE "WYPLATAMY BENEFITS" LOYALTY PROGRAM
hereinafter referred to as: "Terms and Conditions"
- Definitions
For the purposes of these Terms and Conditions, the following terms shall have the meanings set out below:
- Organizer — Maciej Dąbrowski, conducting business activity at: ul. Łojewska 10/28, 03-392 Warsaw, NIP: 1132802300, REGON: 387493416, BDO: 000507167, e-mail: sales@wyplatamy.pl.
- Online Store — the online store operated by the Organizer at https://wyplatamy.pl.
- Program — the loyalty program operated by the Organizer under the name "Wyplatamy Benefits", the rules of which are set out in these Terms and Conditions.
- Participant — a consumer within the meaning of Art. 22¹ of the Civil Code, who holds an Account in the Online Store and participates in the Program in accordance with the Terms and Conditions.
- Account — an individual customer account in the Online Store, enabling the Participant to use the functionalities of the Online Store and, where such functionality is made available, to check the number of accumulated Points and the history of their use.
- Product — a product, service, digital content, or other item available in the Online Store for the purchase of which Points may be awarded, subject to the exclusions provided for in the Terms and Conditions.
- Points — loyalty points awarded to the Participant for purchases of Products in the Online Store, which may be exchanged for a Loyalty Code in accordance with the Terms and Conditions.
- Loyalty Code — an individual discount code generated for the Participant in exchange for a specified number of Points, enabling a reduction in the price of Products in the next order placed in the Online Store.
- Order — an order placed by the Participant in the Online Store.
- Online Store Terms and Conditions — the sales terms and conditions of the Online Store available at https://wyplatamy.pl.
- Privacy Policy — a document setting out the rules for processing personal data in connection with the use of the Online Store and the Program, available at: Privacy Policy.
- General Provisions
- These Terms and Conditions set out the rules for the operation of the Program, in particular the rules of participation, awarding Points, exchanging Points for Loyalty Codes, and using Loyalty Codes.
- The Program is operated in the territory of the Republic of Poland, through the Online Store.
- Participation in the Program is voluntary and free of charge.
- The Program is addressed exclusively to consumers making purchases in the Online Store.
- The Program is not a game of chance, a lottery, a mutual bet, or any other gambling activity within the meaning of applicable law.
- The Program is operated for an indefinite period, subject to the Organizer's right to modify or terminate it in accordance with the Terms and Conditions.
- Conditions of Participation in the Program
- A Participant in the Program may be a natural person who:
- has full legal capacity or acts with the consent of a legal representative, where such consent is required by law;
- holds an Account in the Online Store;
- makes purchases in the Online Store as a consumer;
- does not make purchases in the course of business, professional, wholesale activities, or for the purpose of reselling Products.
- Joining the Program takes place automatically upon creating an Account in the Online Store or in another manner made available by the Organizer in the Online Store.
- The Participant may withdraw from the Program at any time by deleting their Account or by contacting the Organizer at: sales@wyplatamy.pl.
- One Participant may hold only one Account used in the Program.
- Points are assigned to the Participant's Account and may not be transferred to another account, sold, gifted, exchanged between Participants, or passed on to third parties.
- A Participant in the Program may be a natural person who:
- Rules for Awarding Points
- The Participant receives Points for purchasing Products in the Online Store.
- For every full Polish zloty spent on Products in the Online Store, the Participant receives 1 Point.
- The basis for calculating Points is the gross value of the Products covered by the Order, after taking into account discounts, discount codes, promotions, price reductions, and other deductions.
- Points are not awarded for delivery costs, payment costs, additional service costs not directly related to the price of the Products, or other fees charged in connection with the fulfilment of the Order, where these do not form part of the price of the Products.
- If the Participant uses a Loyalty Code or other discount code reducing the value of Products in an Order, Points are calculated solely on the amount actually paid for the Products after applying such code or discount.
- If the value of Products after discounts is expressed in fractions of a Polish zloty, the Organizer may round the basis for calculating Points down to the nearest full zloty.
- Points are awarded upon the simultaneous fulfilment of the following conditions:
- the Order was successfully placed by the Participant while logged into their Account;
- the Order was paid for;
- the Order was fulfilled by the Organizer.
- Points are not awarded for Orders that are cancelled, unpaid, unfulfilled, or returned in full.
- The Organizer may withhold the award of Points or deduct previously awarded Points if they were awarded improperly, by mistake, as a result of a technical error, or in violation of the Terms and Conditions.
- Points are not a means of payment, electronic money, a payment instrument, or a gift voucher. Points may not be exchanged for cash or any monetary equivalent.
- Returns, Withdrawal from Contract, and Points Correction
- In the event of a Product return, withdrawal from a sales contract, cancellation of an Order after Points have been awarded, or any other situation resulting in a full or partial refund of the Product price, the Organizer is entitled to deduct from the Participant's Account the Points awarded for the purchase of the returned Product.
- The number of Points deducted corresponds to the number of Points awarded for the Product to which the return, withdrawal from contract, or Order correction relates.
- If the Participant does not have a sufficient number of Points on their Account to make the correction, the Organizer may reduce the Participant's Points balance to a negative value or take the missing Points into account in the next Points calculation, provided the Online Store's mechanism allows for this.
- If the Online Store's mechanism does not provide for a negative balance, the Organizer may make the Points correction at the earliest technically feasible date.
- A return of a Product purchased using a Loyalty Code shall take into account the price actually paid by the Participant after applying the Loyalty Code.
- In the event of a return of a Product purchased using a Loyalty Code, the Participant shall receive a refund solely of the amount actually paid for the Product after taking into account the value of the used Loyalty Code.
- A used Loyalty Code is not subject to return, exchange for cash, reinstatement, or re-generation in the event of a Product return or withdrawal from contract, unless the Organizer decides otherwise in an individual case.
- Validity of Points
- Points accumulated by the Participant are valid indefinitely, subject to the provisions of the Terms and Conditions.
- Points are forfeited in the event of:
- the Participant's withdrawal from the Program;
- deletion of the Account by the Participant;
- deletion of the Account for reasons provided for in the Online Store Terms and Conditions;
- termination of the Program, upon expiry of the deadline set by the Organizer for using the Points;
- a finding that Points were awarded improperly, by mistake, or in violation of the Terms and Conditions.
- Points may not be exchanged for monetary funds or for any non-monetary equivalent other than the Loyalty Code provided for in the Terms and Conditions.
- Exchanging Points for Loyalty Codes
- The Participant may exchange accumulated Points for a Loyalty Code upon reaching one of the thresholds set out in clause 2 below.
- Points may be exchanged for Loyalty Codes in accordance with the following thresholds:
Number of Points Value of Loyalty Code 250 Points 5 PLN 500 Points 10 PLN 750 Points 15 PLN 1000 Points 25 PLN 2000 Points 55 PLN 5000 Points 135 PLN - Exchanging Points for a Loyalty Code reduces the Participant's Points balance by the number of Points corresponding to the selected threshold.
- The Loyalty Code is an individual discount code assigned to the Participant.
- The Loyalty Code will be sent to the e-mail address associated with the Participant's Account within 3 business days from the date of its generation.
- The Loyalty Code is valid for 90 days from the date of its generation.
- Upon expiry of the validity period, the Loyalty Code expires and may no longer be used.
- An unused Loyalty Code after the expiry of its validity period is not subject to exchange for cash, extension, return, or re-generation.
- The Organizer may refuse to generate a Loyalty Code if there are reasonable grounds to suspect a violation of the Terms and Conditions, abuse, a technical error, or improper accrual of Points.
- Rules for Using Loyalty Codes
- The Loyalty Code may only be used in the Online Store.
- To use the Loyalty Code, the Participant should enter the code in the appropriate field in the shopping cart or in another location indicated during the Order placement process.
- The Loyalty Code reduces the value of the Products covered by the Order.
- The Loyalty Code does not reduce delivery costs, payment costs, or other additional charges, unless the Organizer expressly decides otherwise.
- The Loyalty Code may only be used for an Order where the value of the Products, after taking into account other discounts but before applying the Loyalty Code, amounts to at least 50 PLN gross.
- The Loyalty Code is a single-use code.
- If the value of the Loyalty Code exceeds the value of the Products to which the Loyalty Code may be applied, the unused portion of the Loyalty Code's value is forfeited and is not subject to refund, payment, or further use.
- The Participant may use more than one Loyalty Code within a single Order, provided the Online Store's functionality allows for this.
- Loyalty Codes may be combined with other discount codes, promotions, and discounts available in the Online Store, unless the terms of such promotions or the Organizer's communications provide otherwise, and provided the Online Store's functionality allows for this.
- The Loyalty Code may not be exchanged for cash or any other monetary equivalent.
- The Loyalty Code is not a gift voucher, gift card, payment instrument, or electronic money. It constitutes a form of discount granted by the Organizer.
- The Organizer may refuse to honour a Loyalty Code if:
- the Loyalty Code has expired;
- the Loyalty Code has already been used;
- the Loyalty Code was entered incorrectly;
- the Loyalty Code was obtained or used in violation of the Terms and Conditions;
- there are reasonable grounds to suspect abuse or conduct contrary to the purpose of the Program;
- the minimum Order value conditions have not been met.
- Products Covered by the Program and Exclusions
- The Program covers Products available in the Online Store, regardless of whether they are physical products, digital products, courses, online materials, services, or other products offered by the Organizer, unless the Organizer decides otherwise.
- The Program does not cover:
- delivery costs;
- payment costs;
- wholesale orders;
- orders placed for the purpose of reselling Products;
- purchases made outside the Participant's Account;
- cancelled, unpaid, or unfulfilled purchases;
- other products or services indicated by the Organizer as excluded from the Program.
- The Organizer may temporarily exclude certain Products, Product categories, promotions, or special campaigns from the accrual of Points or the use of Loyalty Codes, provided Participants are informed of this in the Online Store.
- Abuse and Account Blocking in the Program
- The Participant is obliged to use the Program in accordance with the Terms and Conditions, applicable law, good practices, and the purpose of the Program.
- Abuse of the Program includes in particular:
- creating multiple Accounts for the purpose of repeatedly benefiting from the Program;
- making fictitious purchases for the purpose of accruing Points;
- making purchases and returns in a manner indicating conduct contrary to the purpose of the Program;
- exploiting technical errors of the Online Store;
- sharing Loyalty Codes with third parties in order to circumvent the rules of the Program;
- actions aimed at improperly obtaining Points or Loyalty Codes.
- In the event of reasonable suspicion of abuse, the Organizer may temporarily suspend the accrual of Points, the exchange of Points for a Loyalty Code, or the redemption of a Loyalty Code pending clarification of the matter.
- In the event that abuse is confirmed, the Organizer may:
- deduct improperly accrued Points;
- cancel a Loyalty Code obtained in violation of the Terms and Conditions;
- refuse to honour a Loyalty Code;
- exclude the Participant from the Program;
- take other measures provided for by applicable law or the Online Store Terms and Conditions.
- The Organizer will inform the Participant of the measures taken via an e-mail sent to the address associated with the Account.
- Withdrawal from the Program
- The Participant may withdraw from the Program at any time.
- Withdrawal from the Program may take place by:
- deleting the Account in the Online Store;
- sending a withdrawal request to: sales@wyplatamy.pl;
- another method made available by the Organizer in the Online Store.
- Withdrawal from the Program or deletion of the Account results in the loss of all Points accumulated in the Participant's Account.
- Loyalty Codes generated prior to withdrawal from the Program remain valid until the expiry of their validity period, unless they were obtained in violation of the Terms and Conditions.
- After withdrawing from the Program, the Participant may re-join the Program under the terms and conditions currently applicable at the Organizer.
- Complaints Regarding the Program
- The Participant may submit complaints regarding the Program, in particular concerning the accrual of Points, deduction of Points, exchange of Points for Loyalty Codes, or the use of Loyalty Codes.
- Complaints may be submitted:
- electronically to: sales@wyplatamy.pl;
- in writing to the Organizer's address: ul. Łojewska 10/28, 03-392 Warsaw.
- A complaint should contain at least:
- the Participant's full name;
- the e-mail address associated with the Account;
- a description of the matter;
- the Order number, if the complaint relates to a specific Order;
- the Participant's request.
- The Organizer will consider the complaint within 14 days of receipt.
- A response to the complaint will be provided in the same form in which the complaint was submitted, unless the Participant indicates a different form of contact.
- The complaints procedure regarding the Program does not limit the Participant's rights under applicable law, in particular rights related to warranty, non-conformity of goods with the contract, withdrawal from a distance contract, or other consumer rights.
- Personal Data
- The controller of the Participants' personal data is the Organizer.
- Participants' personal data is processed for the purpose of operating the Program, in particular for the accrual of Points, Account management, generation of Loyalty Codes, dispatch of Loyalty Codes, and handling of complaints.
- Detailed information regarding the processing of personal data, the legal bases for processing, data retention periods, and Participants' rights is set out in the Privacy Policy.
- The Participant may contact the Organizer regarding personal data matters at: sales@wyplatamy.pl.
- Amendment of the Terms and Conditions
- The Organizer may amend the Terms and Conditions for important reasons, in particular in the event of:
- changes to applicable law or its interpretation;
- the need to adapt the Terms and Conditions to decisions, recommendations, rulings, or guidelines of public authorities or courts;
- changes to the functionality of the Online Store;
- changes to the rules of operation of the Program;
- the introduction of new benefits, promotions, or functionalities in the Program;
- the need to prevent abuse;
- the need to correct errors, mistakes, or ambiguities in the Terms and Conditions;
- changes to the Organizer's details;
- changes to the technical, organisational, or business conditions for operating the Program.
- An amendment to the Terms and Conditions does not affect rights acquired by Participants before the amendment enters into force.
- The Organizer will inform Participants of an amendment to the Terms and Conditions by e-mail sent to the address associated with the Account at least 7 days in advance.
- A Participant who does not accept an amendment to the Terms and Conditions may withdraw from the Program before the amendment enters into force.
- The Organizer may amend the Terms and Conditions for important reasons, in particular in the event of:
- Termination of the Program
- The Organizer may terminate the Program for important reasons, in particular in the event of:
- changes to applicable law affecting the possibility of operating the Program;
- economic unprofitability of the Program;
- replacement of the Program with another loyalty, promotional, or discount program;
- changes to the business model of the Online Store;
- significant technical problems preventing the further operation of the Program;
- the need to counteract abuse.
- The Organizer will inform Participants of the termination of the Program at least 14 days in advance by e-mail sent to the address associated with the Account.
- In the notification of the Program's termination, the Organizer will indicate the deadline by which Participants may use their accumulated Points or generated Loyalty Codes.
- After the termination of the Program and upon expiry of the deadline set by the Organizer, unused Points are forfeited.
- Loyalty Codes generated before the termination of the Program remain valid until the expiry of their validity period, unless the Organizer indicates more favourable terms for Participants.
- The Organizer may terminate the Program for important reasons, in particular in the event of:
- Final Provisions
- In matters not regulated by the Terms and Conditions, the generally applicable provisions of Polish law and the Online Store Terms and Conditions shall apply.
- The Terms and Conditions are available in the Online Store.
- At the Participant's request, the Terms and Conditions may be sent in electronic form to the e-mail address indicated by the Participant.
- The Terms and Conditions enter into force on: [date of entry into force].
